A RESOLUTION SETTING BOROUGH FEES

A resolution amending the Schedule of Fees charged by the Borough of Boyertown for permits, licenses, and water and sewer rates.

WHEREAS, on April 5, 1993, the Borough Council enacted a Resolution establishing a Schedule of Fees for permits, licenses, and water and sewer charges; and
 
WHEREAS, the said Resolution has been amended by the Borough Council from time to time; and

WHEREAS, it is the desire of the Council to amend further that Schedule to read as follows:

BE IT RESOLVED AND ENACTED by the Council of the Borough of Boyertown, Berks County, Pennsylvania, hereby establishes the following Schedule of Fees to be paid to the Borough upon submission of an application for any permit or license, and for the use of water and sewer in accordance with the Code of the Borough of Boyertown, adopted as Ordinance Number 01-93, April 5, 1993:

SCHEDULE OF FEES

SECTION A - ZONING PERMITS

  1. The following structures, if the structure has a building area less than 1,000 square feet, and is accessory to a detached one or two family dwelling, and multi-family dwelling units:
    1. Detached Carport $50.00
    2. Detached private garage less than 1,000 square $50.00
    3. Greenhouse $50.00
    4. Sheds less than 150 square feet $35.00
      Sheds between 151 square feet to 1,000 Square feet $50.00
  2. All Agricultural Building(s), irrespective of size, as defined by Act 45 Section 103 $50.00
  3. Uncovered decks and patios, with a floor height of 30” or less above $50.00 Finished grade
  4. Fences that are no more than 6’0” in height $35.00
  5. Issuance of a Use and Occupancy Permit for a change of use of an existing Building to a similar type use, with no structural alterations $50.00
  6. Signs
    1. Residential Home Occupation or Home Related Business $35.00
    2. Commercial                                                                                                           
      Replacement or relocation of an existing sign $35.00
      New (less than 30 square feet) $50.00
      New (30 square feet & larger, but less than 60 square feet) $100.00
  7. Prefabricated swimming pools that are less than 24” deep (water design Depth) with a surface area greater than 250 square feet $50.00

BUILDING PERMITS ARE REQUIRED FOR THE FOLLOWING, WITH FEES SET AS FOLLOWS:

All residential buildings and structures over 1,000 square feet and addition(s) to any principal building require a building permit, see Section B.  Except as noted in Section A.  A state mandated fee of $2.00 is charged to the applicant for issuance of building permit.

SECTION B - RESIDENTIAL

  1. New one and two family dwelling unit, multiple family dwelling unit, or similar residential structure; fee shall be computed on a square foot basis as measured out-to-out of the structure, and shall include basements, bays, hallways, stairways, utility rooms, storage rooms,
    lobbies, attached garages, foyers and attics that have a minimum of 6-foot headroom $100.00 plus $0.30 per sq.ft. of floor area
  2. Attached and detached structures and additions accessory to residential dwellings, to include unroofed decks, and patios with a floor height of greater than 30” above finished grade $ 75.00 plus $0.30 per sq. ft. of floor area
  3. Manufactured Housing Units (inspection of basements, Piers, footers and final inspection is required) $ 75.00 plus $0.25 per sq.ft.of floor area
  4. Miscellaneous structural and/or non-structural building activity not specifically exempted by the UCC, Section 403-62 and not identified elsewhere in this fee schedule $ 25.00
  5. Alterations, renovations, or modifications of existing buildings or structures $75.00 plus $0.30 per sq. ft.of floor area
  6. Miscellaneous Communication towers and/or antennas Retaining walls (over 4’ in height) $100.00

SECTION C - COMMERCIAL

  1. Commercial, Industrial, Institutional Buildings $100.00 plus $0.305 per sq.ft. of floor area
    1. Plan review and Accessibility plan review fee $ 50.00 per hr.
    2. Accessibility inspections $200.00
  2. Review of revisions to previously approved plans $ 50.00 per hr.
  3. Additions, alterations, renovations, or modification of existing buildings or structures $100.00 plus $0.30 per sq. ft. of floor area
    1. Plan review and Accessibility plan review fee $ 50.00 per hr.
    2. Accessibility inspections $200.00
  4. Miscellaneous structural and/or non-structural building activity not specifically exempted by the UCC, Section 403-62 Permit requirement and Exemptions and is not permitted in the previous subsections shall require a permit $100.00
  5. Special Structures to include but not limited to towers, storage tanks, cell tower, retaining walls (over 4’ in height) $100.00 plus necessary engineer review fees required to review special structures       
    1. Plan review fee $ 50.00 per hr.
    2. Building Permit fee $100.00 plus $75.00 per inspection as determined by inspector
  6. Accessory Building $ 50.00 plus $0.30 per sq. ft. of floor area

SECTION D - ELECTRICAL

  1. Residential Inspections:
    1. Service inspection $65.00
    2. Rough wiring inspection $65.00
    3. Final inspection $65.00
    Note:   For all new construction requiring all three inspections the charge will be reduced to $175.00.  All inspection fees shall be assessed and payable at time of building permit issuance.  Additional inspections and any required re-inspections shall be completed at the cost of $65.00.
  2. Commercial Inspections:
    1. Plan review $50.00 per hr.
    2. Service inspection $80.00
    3. Rough wiring inspection $80.00
    4. Final inspection $80.00
    5. Commercial Swimming Pool $80.00 per inspection
    Note:   Additonal inspections and any required re-inspections shall be completed at the cost of $80.00

SECTION E - PLUMBING, MECHANICAL AND HAVAC

  1. Residential Permit
    Any plumbing, mechanical and/or HVAC work not associated with a building permit and not exempted by the Uniform Construction Code Section 403.62 Permit Requirements and Exemptions shall require a permit. $ 65.00 per inspection
    Note: 
    The following three inspections are included underslab, rough, final plumbing inspection.
    However, any additional inspections requested by the contractor and any re-inspection shall be completed at the
    Cost of $65.00 per inspection.
  2. Commercial Permit
    1. Any plumbing, mechanical and/or HVAC work not associated with a Building permit and not exempted by the Uniform Construction Code Section 403.62 Permit Requirements and Exemptions shall require a permit. $ 80.00 per inspection
    2. Any plumbing, mechanical and/or HVAC work associated with a building permit shall require plumbing, mechanical and/or HVAC inspections. $80.00 per inspection
    3. Plan Review $ 50.00 per hr.
    Note:  Additional inspections requested by the contractor and any re-inspection shall be completed at the cost of $80.00 per inspection.

SECTION F - MISCELLANEOUS

  1. Demolition Permit:
    1. Residential and detached accessory structure $  50.00
    2. Commercial, Industrial, Institutional and detached accessory structures $100.00
  2. Swimming Pools and spas:
    1. Above ground (except as noted in Section A) includes (1) electrical inspection $150.00
    2. In-ground-includes (2) electrical inspections $300.00
  3. Public Curb and Sidewalk:
    1. Borough Streets with curbs and/or sidewalks $ 75.00
  4. On-lot infiltration bed inspections $350.00
                (Unless secured by subdivision escrow)
  5. Building Permit Renewal Fee $ 50.00

SECTION G - PERMIT CONDITIONS

A permit becomes invalid unless the authorized construction work begins within 180 days after the permit’s issuance or if the authorized construction work permit is suspended or abandoned for 180 days after the work has commenced. A permit holder may submit a written request for an extension of time to commence construction for just cause. The building code official may grant extensions of time to commence construction in writing.

When scheduling inspections, the contractor must ensure he has completed all items necessary for the inspection.  Should the Building Inspector/Zoning Officer be required to make additional inspections, a fee of $75.00 will be due to defray the cost of the inspection.  The entire fee must be paid prior to the inspection.  The fee is paid to the municipality.

Submittal of revised plans at any stage shall be accompanied by 50% of the required initial fee for the plan stage revised and resubmitted.

Any unused portion of the fee will be returned to the subdivider.
If the costs incurred by the Borough in reviewing a subdivision or land development plan exceed the amount of the fee paid by the subdivider, prior to the Borough's endorsement of the plan, the subdivider shall pay to the Borough the amount in excess of the fee which was expended in reviewing the subdivision or land development plan.

SECTION I - ZONING HEARING BOARD FEES ARE AS FOLLOWS:
